Terms of service

By requesting a quote, placing an order or otherwise using km-studio.nl, you agree to the following terms. These terms apply to KM Studio Amsterdam’s 3D design and printing service; a separate set of terms applies to any future KM Studio webshop selling physical products.

  • Quotes generated through the instant quote tool are estimates based on the uploaded model, selected material and technology, and are valid for the period stated at checkout.
  • An order is only confirmed once payment has been received and you have accepted the final quote.
  • Delivery times communicated are indicative. KM Studio will inform you as soon as reasonably possible of any expected delay.
  • KM Studio reserves the right to decline a print job, for example if a file is not manufacturable, infringes a third party’s rights, or is otherwise unsuitable, and will notify you and refund any payment already made for that job.
  • Prices are shown in EUR and, unless stated otherwise, include VAT where applicable to consumers in the Netherlands.
  • Force majeure (including but not limited to machine failure, material shortages, or shipping carrier delays) may affect delivery; KM Studio is not liable for delays caused by circumstances outside its reasonable control.
  • These terms are written for consumers ordering as private individuals. If you are ordering as a business, for example by providing a VAT number or company name at checkout, separate terms may apply and can be agreed in writing before your order is confirmed.
  • If you have a concern about a payment, please contact KM Studio directly before initiating a chargeback with your bank or card provider, so the issue can be resolved without unnecessary cost or delay on either side.
  • Unless agreed otherwise in writing, invoices are payable within 30 days. Late payment puts the customer in default by operation of law, without a further notice of default being required, at which point statutory interest (or 1% per month, whichever is higher) becomes due on the outstanding amount.
  • If payment remains outstanding after a reminder and notice of default, extrajudicial collection costs may be charged, amounting to at least 15% of the outstanding sum with a minimum of €40.
  • Delivered goods remain the property of KMK Productions until payment has been received in full.

Design services

Where KM Studio provides design work, for example modelling a part from a sketch or description, this is shown on your quote as a separate design line item billed at an hourly rate and treated as a professional service, distinct from the printing itself.

  • Design work is invoiced for the time actually spent on it. Once design work has been completed and delivered to you, it is already-performed work and is non-refundable, regardless of whether you decide to proceed with printing afterwards.
  • If you choose not to have a design printed after it has been completed and delivered, only the print itself (not yet produced) can be cancelled without further cost; the design fee for the work already carried out remains due.
  • Under Dutch law, the right of withdrawal for services also ends once the service has been fully performed with your prior express request and your acknowledgement that this right is lost as a result (art. 6:230p sub d BW). By requesting delivery of a completed design, you accept that the design work itself is no longer eligible for withdrawal or a refund.

Ownership of the design. Unless agreed otherwise in writing, the rights to a design created by KM Studio transfer to you only once that design has been paid for in full. If a design is not paid for, or a refund is issued for it, ownership of that design remains with KM Studio Amsterdam and its designers. In that case KM Studio and its designers are free to use, adapt, reproduce, print, or sell that design as they see fit, including in other projects, in KM Studio’s own product range, or in its portfolio, without further obligation to the customer who did not complete payment for it.

Right of withdrawal & cancellations

Under Dutch and EU consumer law, the standard 14-day right of withdrawal for online purchases does not apply to goods that are made to the consumer’s specifications or are clearly personalised (art. 6:230p sub f BW / Consumer Rights Directive 2011/83/EU, art. 16(c)). Because every part KM Studio prints is manufactured on demand from a customer-supplied 3D model, in the material and finish the customer selected, this exemption applies to KM Studio’s print orders.

This does not affect your right to cancel before production has started, or your rights if a delivered part is defective, damaged in transit, or does not match the specification you ordered. See the cancellation and complaints sections below.

KM Studio’s quote platform includes a structured order-cancellation flow available up until a job enters production; once printing has begun, cancellation may no longer be possible because material and machine time have already been committed to your order.

Liability & print tolerances

3D printing is a manufacturing process with inherent physical tolerances. Unless a tolerance is explicitly agreed in writing, KM Studio does not guarantee a specific dimensional accuracy, surface finish, or colour match, and standard tolerances for the selected technology (FDM, SLA or SLS) apply.

  • KM Studio’s liability for any claim is limited to the amount paid for the specific order giving rise to the claim.
  • KM Studio is not liable for indirect, consequential, or business-interruption damages arising from the use of a printed part.
  • The customer is responsible for verifying that an uploaded design is fit for its intended purpose, including for parts subject to mechanical, thermal, or safety requirements.
  • Nothing in these terms excludes liability that cannot be limited or excluded under Dutch law (e.g. liability for intent or gross negligence).

Conformity, defects & repairs

Separately from the withdrawal rules above, you always have the statutory right to receive a part that matches what was agreed: the specification, material and finish you ordered. This conformity right cannot be excluded, including for made-to-order 3D prints.

The following are considered normal characteristics of the printing process, not defects: visible layer lines on FDM prints, minor surface texture on SLA and SLS prints, slight colour variation from what is shown on screen, and dimensional differences within the standard tolerance for the selected technology (see Liability & print tolerances above).

If a delivered part is genuinely defective, for example broken, incomplete, or clearly not matching your order, contact KM Studio within 14 days of delivery. KM Studio’s first response will be to reprint or repair the part. If repeated reprints do not resolve a genuine defect, KM Studio will offer a partial or full refund for that order, capped at the amount paid for it, in line with the liability terms above.

Shipping & transit damage

If your order arrives visibly damaged in transit, contact KM Studio within 48 hours of delivery so a claim can be filed with the carrier while it is still valid. Photos of the damaged part and packaging are helpful but not required to start a claim.

Your files & intellectual property

Files you upload for quoting or printing remain your property. KM Studio does not claim any ownership over uploaded 3D models and will not use, share, or reproduce your designs for any purpose other than fulfilling your order, unless you explicitly agree otherwise (for example, featuring a project in KM Studio’s portfolio).

By submitting a file, you confirm that you own the rights to it, or otherwise have permission to have it printed, and that printing it does not infringe any third party’s intellectual property rights. KM Studio is not liable for infringement arising from files supplied by customers.

Privacy

KM Studio processes personal data in accordance with the GDPR / AVG. Personal data collected through km-studio.nl (such as your name, email address, delivery address, and uploaded model files) is used solely to provide quotes, process orders, arrange shipping, and communicate with you about your order.

  • Order and account data is stored with Supabase (database & file storage).
  • Transactional emails (quotes, order updates, reminders) are sent via Resend.
  • Payments are processed by SumUp; KM Studio does not store your full payment card details.
  • Shipping labels and tracking are handled via PostNL using the delivery details you provide.
  • Data is retained only as long as necessary for order fulfilment, accounting obligations, and legal retention periods, after which it is deleted.

You have the right to request access to, correction of, or deletion of your personal data at any time by contacting kraanenmars.studio@gmail.com. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Cookies

km-studio.nl uses functional cookies necessary for the site and quote tool to work, and may use analytics cookies (Vercel Analytics) to understand site usage in an aggregated, non-identifying way. A Google Ads conversion tag may also be present to measure the effectiveness of KM Studio’s advertising campaigns.

Complaints & governing law

If you are not satisfied with an order, please contact KM Studio directly so the issue can be resolved. Most concerns about fit, finish, or delivery can be sorted out quickly this way.

These terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved directly will be submitted to the competent court in the district where KMK Productions is registered, or, for consumer disputes, may instead be submitted to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
